The appeal of the CBBH against the Official Decision of the Centar Municipality is accepted

The appeal of the Central Bank of Bosnia and Herzegovina (CBBH) against the Official Decision of the Centar Municipality rejecting the request for the issuance of Urban Consent was accepted as well-founded. The procedure was returned to the Centar Municipality for reconsideration.

By unjustified delay of the procedure, the amount of damage suffered by the CBBH significantly increases.

There is an obvious violation of the legal deadlines for acting upon the request of the CBBH, and unfounded and deliberate delay of the procedure which is within the competence of the Centar Municipality. The legal deadline of 15 days for issuing Urban Consent has expired long time ago, and in the meantime the prices of materials and services in the field of construction are growing significantly, especially in the case of complex construction projects such as the business premises of the CBBH Main Unit have been. In this way, serious material damage continues to be caused directly to the CBBH.

The action of the Municipality is expected.

The CBBH expects that the Centar Municipality will act in accordance with the applicable laws and planning documentation in force, and that it will comply with the Decision of the Ministry of Communal Economy, Infrastructure, Physical Planning, Construction and Environmental Protection.

We especially emphasize that the issuance of Urban Consent is a legal obligation of the Municipality, i.e. the Municipality Head.

The Centar Municipality did not meet the requirements pursuant to the request of the CBBH.

Despite the fact that the CBBH showed good will regarding the acceptance of an alternative location for the construction of the business facility of the CBBH Main Unit, the Centar Municipality did not comply with the agreed conditions. This is confirmed also by the letter of the Centar Municipality dated January 10, which shows that starting the process of changing the location would be uncertain, not safe and time-consuming process for the outcome of which the Center Municipality does not provide any guarantee. The CBBH informed the Centar Municipality on the a.m. in a timely manner.
